What is the federal limit on the amount of pay that may be garnished?

The most common type of garnishment is for a child support order. The federal limits applicable to child support orders are:

 

  1. 1. 50 percent of the employee's disposable earnings if the employee is supporting another spouse and/or children; OR
  2. 2. 60 percent of the employee's disposable earnings if the employee is not supporting another spouse and/or children

In the event the employee is more than 12 weeks in arrears, these limits are increased to 55 percent and 65 percent, respectively. Note: state laws may impose a lower limit.
