There is no single definition of independent contractor that applies to all federal payroll tax rules and regulations. The IRS generally applies a common-law test to determine whether the worked is an employee or an independent contractor. In the broadest sense, a worker is an independent contractor when the employer can direct what work will be performed, but not how.
