What is an employee?
There is no single definition of employee that applies to all federal payroll tax rules and regulations. The IRS generally applies a common-law test to determine whether the worked is an employee or an independent contractor. In the broadest sense, a worker is an employee when the employer can direct what AND how work will be performed.
Other worker classifications exist, such as statutory employee and statutory nonemployee.
